EU Hydrogen Market Rules Reach the 5 August Transposition Deadline
The EU deadline for Member States to transpose the hydrogen and decarbonised gas market directive passed on 5 August 2026. National implementation now matters for network access, operator certification and low-carbon hydrogen evidence.
What happened
On 5 August 2026, the deadline passed for EU Member States to bring the main provisions of Directive (EU) 2024/1788 into national law. The directive forms part of the EU hydrogen and gas decarbonisation package with Regulation (EU) 2024/1789.
The European Commission says the package introduces a framework for dedicated hydrogen infrastructure. It also adds terminology and certification rules for low-carbon hydrogen that complement the revised Renewable Energy Directive, including the RFNBO framework.
The deadline is an implementation milestone. It does not prove that every Member State has completed its national measures or that every network rule is already available in the same form.
Why it matters
EU market access now depends on two distinct evidence questions. A producer or buyer must show the product claim, such as RFNBO or low-carbon hydrogen, and must understand the national rules for the network, operator and route used to move that product.
For certifiers, the package increases the need to keep product emissions evidence separate from infrastructure and custody records. A network connection or operator certificate does not prove that the hydrogen meets RFNBO, GHCI or another product standard.
HyGOAT implication
HyGOAT should extend Screen and export readiness checks to capture:
- destination Member State and national transposition status;
- hydrogen network operator and certification status;
- access, connection and route evidence;
- the product pathway and emissions boundary; and
- links between production records, custody records and the relevant certificate.
The platform should keep EU network readiness distinct from GHCI, RFNBO and JCM certification. That separation will help producers identify missing evidence before a buyer or verifier reviews the file.
Risks and caveats
- National laws, regulator decisions and network codes can differ after transposition.
- The milestone does not amend the RFNBO Delegated Acts or create mutual recognition between GHCI and an EU scheme.
- Importers should confirm the applicable national rules before treating an EU route as export-ready.
